   1. Graphie Studio: Refers to the web3 community platform that allows users to chat, discuss, share photos and videos, play games, and participate in a loyalty program with blockchain technology.
   2. Platform: Refers to the Graphie Studio website, mobile applications, desktop applications, and other digital channels used to access the Graphie Studio platform.
   3. User: Refers to any individual who accesses or uses the Graphie Studio platform.
   4. User Account: Refers to the personal account created by a user to access and use the Graphie Studio platform.
   5. User-Generated Content: Refers to any content that a user creates, uploads, publishes, or shares on the Graphie Studio platform, including text, images, videos, and other multimedia content.
   6. Intellectual Property: Refers to all proprietary rights, including but not limited to patents, trademarks, copyrights, trade secrets, and other intellectual property rights associated with the Graphie Studio platform and its content.
   7. Data Protection: Refers to the measures taken by Graphie Studio to protect user data and comply with relevant data protection laws and regulations.
   8. Confidentiality: Refers to the obligation of Graphie Studio and its users to keep certain information private and confidential, including user data and proprietary information.
   9. Dispute Resolution: Refers to the process of resolving disputes or conflicts that may arise between Graphie Studio and its users.
   10. Governing Law: Refers to the laws and regulations that govern the use of the Graphie Studio platform, including this terms of service agreement.
3. User Rights and Obligations
   1. User Accounts
      Users must create an account to access Graphie Studio's services. Users are responsible for keeping their account information and login credentials confidential and secure. If users suspect that their account information has been compromised, they must inform Graphie Studio immediately.
      
      Users must provide accurate and truthful information when creating their account. They are prohibited from creating fake or fraudulent accounts, misrepresenting themselves, or impersonating others.
      
      Graphie Studio reserves the right to suspend or terminate accounts that violate these terms, engage in illegal or unethical behavior, or pose a risk to the security or integrity of the platform.
   2. User Conduct
      Users must comply with all applicable laws and regulations when using Graphie Studio's services. Users are prohibited from engaging in any activity that is illegal, fraudulent, or unethical, including but not limited to:
      
      Hacking or attempting to gain unauthorized access to the platform's systems or data Posting or sharing content that is pornographic, violent, defamatory, or discriminatory Sending spam, unsolicited messages, or other forms of unwanted communication Creating or participating in scams, pyramid schemes, or other fraudulent activities Violating the intellectual property rights of others, including but not limited to copyright, trademark, and patent laws Graphie Studio reserves the right to remove or block any content or user that violates these terms or any applicable law or regulation.
   3. User-Generated Content
      Users are responsible for the content they post, share, or upload to the platform. Users must ensure that their content does not violate any applicable law or regulation or infringe on the rights of others, including but not limited to intellectual property rights.
      
      Graphie Studio does not claim ownership over user-generated content. However, by posting content to the platform, users grant Graphie Studio a non-exclusive, royalty-free, worldwide, and perpetual license to use, reproduce, modify, adapt, publish, and display the content for the purpose of providing and promoting the platform's services.
      
      Users may not use or reproduce any content posted by other users without their permission. Users may report any content that they believe violates these terms or any applicable law or regulation.
4. Platform Usage and Availability
   1. Platform Access:
      Graphie Studio is a web3 platform, which means that users need access to a compatible browser or application with web3 functionality to access Graphie Studio. The platform can be accessed via desktop, web, mobile (iOS and Android), and VR or metaverse games. Users are responsible for ensuring that their device is compatible with the platform and meets the technical requirements necessary for accessing Graphie Studio.
      
      Users may need to create an account to access certain features or services provided by Graphie Studio. Account creation is subject to Graphie Studio's terms of service and privacy policy.
   2. Platform Availability:
      Graphie Studio strives to provide users with uninterrupted access to the platform, but it does not guarantee the availability of the platform or its services. The platform may be subject to scheduled or unscheduled maintenance, upgrades, or other events that may result in downtime or service disruptions.
      
      Graphie Studio reserves the right to modify, suspend, or terminate the platform or any of its services at any time, without prior notice or liability. In the event of a service disruption or termination, Graphie Studio will make reasonable efforts to notify users of the disruption or termination via the platform or other means deemed appropriate by Graphie Studio.
      
      Graphie Studio shall not be liable for any damages or losses incurred by users or any third party as a result of the platform's unavailability or service disruptions, except as otherwise provided by applicable law.
5. Intellectual Property
   1. Ownership
      All content and materials available on the Graphie Studio platform, including but not limited to text, graphics, images, logos, icons, videos, software, and other materials, are the property of Graphie Studio and/or its licensors and are protected by copyright, trademark, and other intellectual property laws. Users may not use, copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content or materials obtained from the Graphie Studio platform without prior written consent from Graphie Studio or the respective owner.
   2. Use of Platform Content
      Users may access and use the content and materials available on the Graphie Studio platform solely for their personal, non-commercial use. Users may not use the content and materials for any commercial purpose, including but not limited to advertising, marketing, or promoting any product, service, or business without prior written consent from Graphie Studio or the respective owner. Any unauthorized use of the content and materials may violate intellectual property laws and result in legal action.
6. Confidentiality and Privacy
   1. Data Protection
      Graphie Studio respects the privacy of its users and takes data protection seriously. Graphie Studio collects and processes personal data in accordance with its privacy policy, which can be accessed on the Graphie Studio platform. By using the Graphie Studio platform, users agree to the collection and processing of their personal data in accordance with the privacy policy.
   2. Confidentiality
      Users acknowledge and agree that any information, data, or content they provide or upload to the Graphie Studio platform may be accessed and used by Graphie Studio for the purposes of providing and improving the platform's services, as well as for other business purposes. Graphie Studio takes appropriate measures to safeguard the confidentiality of user data and content, but users acknowledge that no security measures are foolproof and that Graphie Studio cannot guarantee the absolute security of user data and content.
7. Dispute Resolution and Governing Law
   1. Dispute Resolution
      Any dispute or claim arising out of or in connection with the Graphie Studio platform or these terms of service shall be resolved through arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English in San Francisco, California, and the arbitrator's decision shall be final and binding.
   2. Governing Law
      These terms of service shall be governed by and construed in accordance with the laws of the State of California without giving effect to any principles of conflicts of law. Users agree to submit to the jurisdiction of the state and federal courts located in San Francisco, California for any dispute arising out of or in connection with the Graphie Studio platform or these terms of service.
8. Modifications and Termination
   1. Modifications to Terms of Service
      Graphie Studio reserves the right to modify these terms of service at any time, and such modifications shall be effective immediately upon posting on the Graphie Studio platform. Users are responsible for regularly reviewing the terms of service for any updates or changes. Users' continued use of the Graphie Studio platform after any modifications to the terms of service shall constitute their acceptance of the modified terms.
   2. Termination of User Accounts
      Graphie Studio reserves the right to terminate or suspend a user's account and access to the Graphie Studio platform at any time for any reason, including but not limited to a violation of these terms of service. Upon termination or suspension, users shall immediately cease using the Graphie Studio platform, and Graphie Studio shall have no liability or obligation to users for such termination or suspension.
9. Limitation of Liability and Disclaimer of Warranties
   1. Limitation of liability
      Graphie Studio and its affiliates, officers, employees, agents, and licensors shall not be liable for any damages, whether direct, indirect, incidental, special, or consequential, arising out of or in connection with the use of the platform or any content provided by or through the platform, including but not limited to damages for loss of profits, business interruption, or loss of data, even if Graphie Studio has been advised of the possibility of such damages.
   2. Disclaimer of warranties
      Graphie Studio makes no representation or warranty, express or implied, regarding the platform or any content provided by or through the platform, including but not limited to the accuracy, completeness, reliability, suitability, availability, or timeliness of the platform or any content. The platform and all content are provided on an "as is" and "as available" basis. Users use the platform and any content at their own risk.
10. General Provisions
    1. Entire agreement
       These terms of service, together with any additional terms, policies, or agreements posted on the platform, constitute the entire agreement between Graphie Studio and users regarding the use of the platform and supersede all prior or contemporaneous communications and proposals, whether oral or written, between Graphie Studio and users.
    2. Severability
       If any provision of these terms of service is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
    3. Waiver
       The failure of Graphie Studio to enforce any right or provision of these terms of service shall not be deemed a waiver of such right or provision.
    4. Assignment
       Users may not assign these terms of service or any rights or obligations hereunder, whether by operation of law or otherwise, without the prior written consent of Graphie Studio. Graphie Studio may assign these terms of service or any rights or obligations hereunder without notice or consent.
    5. Notices
       Any notices or other communications permitted or required hereunder, including those regarding modifications to these terms of service, will be in writing and given by Graphie Studio via email or by posting to the platform. Users should keep their contact information up to date to ensure receipt of any such communications.
